Crown Prosection Service - in gay surrey

The Crown Prosecution Service (CPS) is the Government Department responsible for prosecuting criminal cases investigated by the police in England and Wales. As the principal prosecuting authority in England and Wales, we are responsible for:

  • advising the police on cases for possible prosecution;
  • reviewing cases submitted by the police;
  • determining any charges in all but minor cases;
  • preparing cases for court;
  • presenting cases at court.

The CPS is independent from the police and the court service. The police refer cases to us, we then apply the Code for Crown Prosecutors and will proceed with cases where there is a realistic prospect of success and it is in the public interest to prosecute. The CPS then prepare and present the cases in either the Magistrates Court or the Crown Court.

The CPS is working together with Gay Surrey in order to raise awareness of crimes which have a homophobic or transphobic element.

It is clear that crimes are not being reported due to victims not having faith in the criminal justice system.

We would like to change that and pledge our commitment to bringing offenders to justice and providing support to victims at court. Although it is ultimately the Magistrates or Judges who make the decision as to sentencing of offenders, we will make representations in court for sentences which accurately reflect the fact that the offence was aggravated by a homophobic or a transphobic element.
